6. Right of Withdrawal (Consumers only)
Consumers within the European Union have the right to withdraw from this contract within 14 days without giving any reason.
The withdrawal period is 14 days from:
- The day on which you receive the goods (for physical products), or
- The day of the conclusion of the contract (for digital products or services).
To exercise your right of withdrawal, you must inform us by means of a clear declaration (e.g., a letter sent by post or email) of your decision to withdraw from this contract within the withdrawal period.
Consequences of Withdrawal If you withdraw from this contract, we will reimburse all payments we have received from you, including the costs of delivery (with the exception of additional costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.
Expiry of the Right of Withdrawal for Digital Content The right of withdrawal expires prematurely for contracts regarding the delivery of digital content (non-tangible goods) if:
- The execution of the contract has begun (i.e., the download link has been provided or access granted), AND
- You have expressly consented to the commencement of the execution of the contract before the expiry of the withdrawal period, AND
- You have confirmed your knowledge that by giving this consent, you lose your right of withdrawal.
7. Warranty, Liability, and Voluntary Refunds
7.1 Statutory Warranty We are liable for material defects and defects of title in accordance with the applicable statutory provisions.
7.2 Limitation of Liability We are only liable for damages resulting from intent, gross negligence, or breach of essential contractual obligations (cardinal obligations). In the event of a slightly negligent breach of essential contractual obligations, our liability is limited to the foreseeable, typically occurring damage. This limitation does not apply to damages resulting from injury to life, body, or health.
7.3 Voluntary Refunds for Digital Goods Outside of the statutory warranty rights, and since the right of withdrawal generally expires for digital goods upon access (see Section 6), we generally do not offer refunds for “change of mind” or incompatibility issues where system requirements were clearly stated. However, strictly as a voluntary gesture of goodwill, we may offer a refund in specific cases such as:
- Duplicate orders: You accidentally purchased the same product twice.
- Technical errors: Proven technical defects clearly caused by our files that cannot be resolved.
